Criminal Law Experience

     

Defense

The Federal Criminal Code and Rules, and The Federal Sentencing Guidelines Manual;     attend arraignments, prepare bail applications, conduct investigation, discovery and    motion practice, engage in plea negotiations, attend allocutions, prepare for and conduct            trials; maintain itemized time and prepare monthly billing statements.

United States Criminal Justice Act, Panel Member          

Obtain assignments from United States Magistrate Judges to represent criminal      defendants who qualify financially for appointment of counsel.

 

Prosecution

Albany County Special District Attorney; 30 appointments pursuant to County Law §701

Responsibilities include coordinating criminal prosecutions with City and County Law      Enforcement personnel; conducting arraignments and making bail recommendations;             preparing and conducting grand jury presentations; offering appropriate plea bargains;     attending allocutions preparing for jury selection and trials.

 

Personal Injury Litigation

Job responsibilities include:  investigation, development and assessment of facts of case;   application of the law; assess client credibility and history; obtain retainer agreements;      analyze anticipated outlay of expenses and discuss with clients; prepare complaints,       conduct discovery and depositions, engage in motion practice and settlement       negotiations, prepare for and conduct mediations, arbitrations and trials; maintain itemized time and review work-in-progress sheets.

 

Insurance Litigation

Job responsibilities include:  defense of roadway claims against municipalities and claims against Police Departments/Officers in state and federal court; maintain itemized time            and prepare quarterly billing statements; prepare Answers with Affirmative Defenses and     Cross-Claims, conduct discovery and depositions, engage in Motion practice and         settlement negotiations; prepare for and conduct mediations, arbitrations and trials;       prepare Case Analysis Reports and Litigation Budgets.

Municipal Representation

      Town of Germantown Town Attorney                                                          2004 – 2005

Employed as independent contractor to attend Town and Planning Board meetings,          represent the Town’s interests on various zoning issues and in defense of claims,       maintain itemized time and prepare monthly billing statements.

Employed as independent contractor to represent the City Treasurer in defense of a           lawsuit commenced by the City Comptroller – obtained dismissal.
